TERMS AND CONDITIONS

1. AGREEMENT TO TERMS
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Member,” “Partner,” or “User”) and TeqBooster, the owner and operator of FitPass (“we,” “us,” or “our”). By accessing or using the FitPass platform at fitpass.teqbooster.net, you confirm that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must immediately discontinue use of our Platform.
2. DESCRIPTION OF SERVICE
FitPass is a multi-gym membership platform that allows members to access multiple partner locations using a single digital QR membership card. FitPass operates as an intermediary between members and partner locations and does not own or operate any fitness or wellness facilities.
3. ELIGIBILITY
To use FitPass, you must:
– Be at least 18 years of age
– Be a resident of or visiting the Kingdom of Saudi Arabia or the State of Qatar
– Provide accurate and complete registration information
– Have a valid payment method
4. MEMBERSHIP
4.1 Membership Plans
FitPass offers multiple membership tiers (Regular, VIP, and Premium), each providing different levels of access to partner locations. Details of each plan, including pricing and access rights, are available on our Membership Levels page.
4.2 Membership Duration
Memberships are sold on a monthly basis and expire automatically at the end of the paid period unless renewed.
4.3 Membership Card
Upon purchasing a membership, you will receive a digital QR membership card. This card:
– Is personal and non-transferable
– Refreshes every 60 seconds for security purposes
– Must be presented at partner locations to gain access
– Remains valid only while your membership is active
4.4 Check-in Policy
– Members are permitted one (1) check-in per partner location per day
– Check-ins are recorded and monitored
– Attempting to share your QR code with another individual is strictly prohibited and may result in immediate account termination
5. PAYMENT AND BILLING
5.1 Fees
Membership fees are as displayed on our Platform at the time of purchase. All prices are inclusive of applicable taxes.
5.2 Payment Processing
Payments are processed securely through our authorized payment gateway. By providing your payment information, you authorize us to charge the applicable membership fee.
5.3 Renewal
Memberships do not automatically renew. You must manually renew your membership before the expiry date to maintain continuous access.
5.4 Refund Policy
All membership purchases are final and non-refundable, except where required by the consumer protection laws of the Kingdom of Saudi Arabia or the State of Qatar. If you believe you are entitled to a refund, please contact us at info@teqbooster.net within 7 days of purchase.
6. CANCELLATION
6.1 Member Cancellation
You may cancel your membership at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. No refunds will be issued for unused days.
6.2 Termination by FitPass
We reserve the right to suspend or terminate your account immediately and without notice if you:
– Violate any provision of these Terms
– Attempt to share, sell, or transfer your membership card
– Engage in fraudulent activity
– Provide false registration information
– Abuse or harass any partner location staff
7. PARTNER LOCATIONS
7.1 Access Rights
Access to partner locations is subject to the membership tier you have purchased. FitPass does not guarantee access to any specific partner location and reserves the right to add or remove partner locations at any time.
7.2 Partner Rules
When visiting a partner location, you agree to:
– Comply with the rules and regulations of that location
– Treat staff and other members with respect
– Use the facilities responsibly and safely
7.3 Disclaimer
FitPass is not responsible for any injury, loss, or damage that occurs at a partner location. Your use of partner facilities is entirely at your own risk.
8. INTELLECTUAL PROPERTY
All content on the FitPass Platform, including logos, text, graphics, and software, is the property of TeqBooster and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, TeqBooster and FitPass shall not be liable for:
– Any indirect, incidental, or consequential damages
– Loss of data or business interruption
– Personal injury or property damage occurring at partner locations
– Service interruptions or technical failures
Our total liability to you shall not exceed the amount you paid for your membership in the 30 days preceding the claim.
10. INDEMNIFICATION
You agree to indemnify and hold harmless TeqBooster, FitPass, and their officers, employees, and partners from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.
11. PRIVACY
Your use of FitPass is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at fitpass.teqbooster.net/privacy-policy.
12. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Platform. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms.
13. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Saudi Arabia.
14. SEVERABILITY
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
15. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TeqBooster regarding your use of FitPass and supersede all prior agreements.
